Terms of Service

The service

Noviquiz is a free platform for creating and hosting real-time quizzes for teams, individuals, and classrooms. We may add, change, or remove features at any time, and we don't guarantee the Service will always be available or error-free.

1. Acceptance of terms

By creating an account or otherwise using Noviquiz ("Noviquiz", "the Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service.

2. Accounts

You must provide accurate, current information when you create an account, and keep it up to date. You're responsible for keeping your login credentials (including your password) secure and for all activity that happens under your account. If you use Google sign-in, that's also subject to Google's own terms. We may suspend or terminate accounts that violate these Terms.

3. User-generated quizzes

You own the quizzes, questions, and other content you create ("Your Content"). By submitting Your Content to Noviquiz, you grant us a non-exclusive, worldwide, royalty-free license to store, copy, display, and distribute it, and to modify it only as reasonably necessary for technical reasons (for example, reformatting a file you imported, or resizing an image) — all solely to operate and improve the Service, such as showing your questions to participants during a live game. This license also lets us create and retain backups of Your Content. It ends when you delete the content or your account, except for backup copies retained for a limited time as described in our Privacy Policy.

Participant data you collect

If you enable Lead Capture or otherwise collect information from your quiz participants, you are the party responsible for that data under applicable privacy law, not Noviquiz. You should only collect what you need, tell participants how you'll use it, and handle it responsibly, especially if participants are minors.

4. Intellectual property

You're responsible for having the rights to any content you upload or import (including via Excel/CSV import), and you promise that Your Content doesn't infringe anyone else's intellectual property rights. For example, don't upload copyrighted quiz books or exam questions, paid quiz databases, copyrighted images or logos, or movie screenshots, unless you own the rights or have permission to use them.

5. AI-generated questions

If Noviquiz offers a feature to help generate quiz questions using AI, that output may be inaccurate, and you're responsible for reviewing and verifying it before use. AI-generated content may also resemble existing works by chance; we make no guarantee that it is original or free of third-party rights, and you use it at your own risk.

6. Copyright complaints

If you believe content on Noviquiz infringes your copyright, email legal@noviquiz.com with a description of the copyrighted work, the material you believe infringes it (including a link or enough detail to locate it), and your contact information. We'll review the report and may remove or disable access to the content and notify the host who submitted it.

7. Acceptable use

You agree not to use Noviquiz to:

• Create or host content that is illegal, hateful, threatening, or harassing.
• Distribute malware or spam.
• Impersonate another person or organization.
• Cheat, or help others cheat, in a quiz or competition.
• Infringe anyone's copyright or other intellectual property rights.
• Attempt to disrupt, overload, or gain unauthorized access to the Service.
• Collect participant data (via Lead Capture or otherwise) for purposes you don't disclose to participants.

8. Moderation

We may, but aren't obligated to, review content on Noviquiz. We reserve the right to remove quizzes or other content, delete content that violates these Terms, investigate suspected abuse, and suspend or terminate accounts, at our discretion and without prior notice.

9. Quiz accuracy

Quiz questions, answers, and other educational content on Noviquiz are created by hosts and provided "as is." We don't review quizzes for accuracy, and answers may be incorrect or outdated. Don't rely on any quiz content as professional, medical, legal, or other expert advice.

10. Competitions and prizes

Hosts may use Noviquiz to run competitions or offer prizes to participants. If you do, you're solely responsible for administering the competition, awarding any prizes, and resolving any disputes with participants, and for complying with any laws that apply to contests, sweepstakes, or promotions. Noviquiz is not a sponsor of, and isn't responsible for, any competition or prize run by a host, unless we explicitly state otherwise.

11. Disclaimer of warranties

Noviquiz is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Noviquiz and its operator won't be liable for any lost profits, lost data, or indirect, incidental, special, or consequential damages, or for any interruption of the Service, arising from your use of, or inability to use, the Service.

13. Indemnification

You agree to indemnify and hold Noviquiz and its operator harmless from any claims, losses, or expenses (including reasonable legal fees) arising from: quizzes or other content you host that are illegal or violate these Terms, your infringement of someone else's intellectual property rights, or your misuse of the Service.

14. Termination

You may stop using Noviquiz and delete your account at any time from the Account page. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you (for example, by email or a notice on the Service). Continuing to use Noviquiz after a change means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Where a dispute isn't subject to mandatory arbitration or small-claims court, and to the extent enforceable, you and Noviquiz agree that it will be brought exclusively in the state or federal courts located in California.
